Bauer Media has won a High Court case brought by Classic Hits Radio over its use of the Greatest Hits Radio branding in Ireland, The Journal reports.
Choice Broadcasting Limited, which owns Ireland’s Classic Hits Radio, had argued that Bauer’s Greatest Hits brand was too similar to its own, citing similarities in the names, music playlists and target audiences.
However, the High Court found that Choice had failed to establish misrepresentation likely to cause confusion and declared the Classic Hits trademark invalid.
Classic Hits Radio has used the Classic Hits name since 2011 and has broadcast under its current name, Ireland’s Classic Hits Radio, for the past three years.
Greatest Hits Radio launched on DAB+ in June last year but was served an interim injunction by Bay Broadcasting to cease using the name on the basis that it caused confusion with Classic Hits Radio.
The court ruled in Bauer’s favour on Friday 2nd October, rejecting Choice’s claim that the branding amounted to misrepresentation likely to cause confusion.
